Nurses to vote on union representation at some affiliate sites
The Labour Relations Board produced a list Friday of work sites where nurses (LPNs and RNs) will be voting on union representation – and others where a single union will represent nurses in the Nurses' Bargaining Association in the future.
The votes result from an August LRB decision on the impact of Bill 18 on union representation in workplaces where more than one union currently represents nurses.
Bill 18 moved LPNs from the facilities and community health subsectors to the NBA but the legislation itself did not speak to the issue of union representation and the issue was referred to the LRB.
In its August decision the LRB determined that nurses could not be represented by multiple unions at one work site. At work sites where no union represents a clear majority (two-thirds or more) of all nurses (LPNs and RNs) representation votes would be taken.
If one union represented a clear majority (two-thirds or more) of all nurses (LPNs and RNs), that union would be the sole representative of those nurses.
The decision does not impact LPNs who moved to the BCNU in October, 2012 as a result of the 2011 raid on HEU. The majority of LPNs impacted work in facilities subsector “affiliates” as well as community health subsector affiliates.
A determination on union representation for nurses directly employed by health authorities in the community subsector is expected next week.
The August decision also dismissed raid applications filed by BCNU at many of the sites on this list. Nevertheless, BCNU may attempt to raid sites where HEU has been certified as the NBA union for all nurses.
Following is a summary of workplaces where a) representation votes will occur; b) HEU will become the NBA union representing all LPNs and RNs; and c) BCNU will become the NBA union representing all LPNs and RNs.
The LRB has not yet set out a schedule for the representation votes. Where nurses are being transferred, the effective date of transfer will be effective the first pay period after September 20.
