How to write or update your by-laws

Step 1: Review your minutes

Start by reviewing past meeting minutes and identifying standing motions your local has already passed that were intended to be ongoing.

These motions may form the foundation of your by-laws.

Step 2: Review what is current, and what isn’t

Ask:

  • Is this still relevant?
  • Is this still what the membership wants?
  • Is the wording clear?
  • Are there gaps where the local needs clearer direction?

If newer motions replace older ones, ensure older language is removed or reconciled.

Step 3: Do not rely on “past practice” alone

Informal habits or unwritten practices are not by-laws.

If your local relies on a practice that has never been formally adopted by motion, consider formalizing it.

Step 4: Draft your by-laws

Organize the by-laws into clear sections.

Many locals include sections on:

  • Executive structure
  • Shop stewards and JOHS appointments
  • Local elections
  • Meeting schedule
  • Budget and spending authorities
  • Affiliations and donations (if applicable)

Use clear language. Avoid ambiguity.

Step 5: Provide notice of motion

Adopting or amending by-laws requires a notice of motion.

Provide notice to the membership that the by-laws will be introduced at a future meeting.

Step 6: Debate and adopt at a meeting with quorum

Bring the proposed by-laws to a meeting with quorum.

Members may debate and propose amendments.

Once finalized, the by-laws are adopted by motion.

Step 7: Submit to the Provincial Executive for approval

All local by-laws — and any amendments — must be submitted to the Provincial Executive for approval.

Some provisions may not take effect until approved.

How to submit your by-laws

You can submit your by-laws in one of three ways:

Submission must include:

  • A copy of the proposed or amended by-laws
  • The meeting date they were adopted
  • Confirmation they were passed at a meeting with quorum
  • Any supporting documentation requested
